Lawsuit filed in connection with Amtrak derailment

Many California residents have likely seen the extensive news coverage of the Amtrak derailment that took place in Philadelphia on May 12. The accident left eight people dead and injured more than 200 others. A few of those who were injured were employees of the transportation company. Investigative efforts by the National Transportation Safety Board and the Philadelphia Police Department continue to determine the cause of the accident.

A conductor who was injured in the passenger train accident has filed a personal injury lawsuit against Amtrak, alleging negligence. Reports on the accident indicate that the train went from 70 mph to approximately 106 mph just prior to the crash. Authorities are considering a range of possible causes for the increase in speed, including human error and equipment malfunction.

The plaintiff in the recently-filed lawsuit had been in the restroom when the accident occurred. Possibly the most seriously injured of the several Amtrak employees who were on the train at the time, he remains in critical condition. He suffered multiple broken bones, including the neck, back and both shoulders, and will reportedly need several weeks of hospitalization to recover. Other injured victims have also initiated legal action against Amtrak based on negligence. The 32-year-old train engineer sustained a concussion in the event and claims not to remember any details that could indicate a cause of the accident.

If an accident involving public transportation occurs, a lawyer might be able to determine the possible legal remedies that are available to an injured victim. By examining accident investigation reports as well as other evidence, it may be possible to determine that negligence on the part of the transport company or one of its employees was the cause.
