Woman charged with DUI in death of 3-year-old family friend

A 34-year-old Redlands woman was arraigned Tuesday, May 2, 2017, in San Bernardino Superior Court on charges of driving under the influence (DUI), vehicular manslaughter and murder, all stemming from an accident that claimed the life of a 3-year-old boy on Thursday, April 27, 2017. A factor that makes this story even worse is that the defendant in this case is a family friend.

Wrongful death lawsuits stemming from vehicle defects

While many wrongful death lawsuits are filed each year in response to a family member having been struck by another driver, those alleged to have occurred as the result of a design or manufacturing defect are quite common as well. In fact, most annual car recalls filed each year and done so in response to accidents.

What are the elements of a wrongful death case?

When a loved one is killed in an accident, the surviving spouse or family members have a right to file a wrongful death claim against the party responsible. Most of the time, these lawsuits come after a criminal trial. For example, if someone is murdered, the family may pursue a wrongful death claim against the person they believed caused their loved one's death. However, these also occur after traffic accidents or medical errors that result in deaths, too.

That baby product could be lethal, but you're not alone

When you give your child a product like a teething ring or teething drops, you want that product to be safe for him. Sometimes, products pose a danger that you don't expect. For example, in 2016, there was news about teething tablets that could be loosely linked to the deaths of 10 children. Another report from the American Academy of Pediatrics informed parents that no soft bedding, including the very popular bumper systems, should be used in cribs.

Drowning may justify a wrongful death suit

Whenever a person dies in an accident, there is an justifiable desire on the part of family and loved ones to find someone to hold responsible. If a life was lost due to drowning, there are number of ways that a person or organization could be legally liable, depending on the circumstances.

Calculating the value of a life is a monumental task

Whenever a life is wrongfully taken, there is the potential for a wrongful death lawsuit to find a fair remedy for the losses of the survivors of the individual who was killed. At a cursory glance, the law provides relatively plain guidelines for determining lost projected earnings and other kinds of economic damages, but California also provides for wrongful death claims to seek compensation for much more personal losses. This presents an extremely complex negotiation that can be just as much an exercise in philosophy as arithmetic.

Manufacturing defects can be deadly

Manufacturing defects in automobiles can cause a variety of problems, from the annoying to the fatally dangerous. If you believe that your vehicle may have a manufacturing defect, it is not wise to wait for something to go wrong. A cursory understanding of what can be classified as a manufacturing defect can help you decide how to proceed.

Understanding wrongful death suits

Under any circumstances, the death of a loved one is a devastating tragedy. But when that death was the result of murder or criminal neglect, the law has the power to seek punishment for those responsible. Even if an if an individual is found guilty of criminal charges, they may also be held liable in civil court.
