Drowning may justify a wrongful death suit

Whenever a person dies in an accident, there is an justifiable desire on the part of family and loved ones to find someone to hold responsible. If a life was lost due to drowning, there are number of ways that a person or organization could be legally liable, depending on the circumstances.

If a person has drowned because of the actions or negligence of another person, or because the body of water in which the drowning occurred was not properly maintained or made safe, then there may be grounds for a wrongful death suit. Every year, for instance, many people engage in reckless behavior on jet skis and boats, or use them in areas that too congested for safe operation. If an individual is knocked off of a water vehicle and then struck by the same vehicle or another in the area, then there may be legal liability.

Similarly, if a pool or other swimming go area is maintained by an individual or company, and that pool is not kept in good working order, especially when it comes to drain covers, then a person may drown because of a poorly maintained pool. In this case, the owner of the pool may be held liable. In a similar way, a lifeguard who is neglectful of his or her duties may be held legally liable, or else the employer may be held liable, if there is a drowning under that lifeguard's shift.

These are only a few instances that illustrate how a drowning, even one that is an accident where there was no malice, can still carry legal liability.
