Types of damages you can pursue in your auto accident case

If you've been involved in a car crash, then there's a strong chance that you've not only had your car damaged, but you've suffered injuries and lost some wages as well. Depending on who is seen as the negligent party in the crash, you might be entitled to reimbursement of your medical bills, lost wages and other compensation by filing an accident claim.

Injuries that an individual may suffer from in an accident fall into one of two categories: either generic or special damages. As for the former, they include those injuries that cause an individual a specific type of economic harm. Some examples of this include property damage costs, lost wages and medical expenses.

As for general types of damages, these can include less tangible costs. Some examples of "noneconomic damages" include pain and suffering, an individual suffering a life-shortening injury or one that adversely impacts their reputation.

It also may include a loss the companionship of a loved one, emotional or mental suffering or someone losing interest in something they used to enjoy. Physical impairments or disfigurements as well as pain and suffering are also types of noneconomic damages.

While special damages may be easy to quantify by simply viewing either bills or wage statements, assigning a value to general ones can be much more of a subjective process. There are a number of factors that can greatly impact the value of that injury in the victim's life.

Some factors that can impact how valuable a general damage is include how long it take to recover from the injury or whether it has a potential to have lasting impact on their life. Where the injury is and whether it left behind permanent scarring or some type of permanent disfigurement is also important. An individual's socio-economic status or political affiliations can impact the value of his or her injury as well.

In some jurisdictions, there are certain caps to damages that can be awarded, especially when it comes to certain defendants that are sued. How much is awarded in special damages can also greatly impact how much in general damages will be offered.
